PA Legislators File Federal Civil Lawsuit

FEDERAL CIVIL RIGHTS LAWSUIT

Freedom Caucus members of the PA Legislature on Thursday, 1/25, filed a federal civil rights lawsuit against President Biden, Governor Shapiro, and PA Secretary of State Schmidt.

The PA Legislators are seeking redress from the court for the overreach of the executive branches of the federal and state governments with respect to election processes. Through the Elections Clause and the Electors Clause of the U.S. Constitution, state legislators are given the right to establish the rules and procedures of federal elections.

Some processes established that skirted the legislature and violate existing law include:

  • Federal agencies were ordered to partner with White House selected, undisclosed 3rd party organizations to run voter drives and get out the vote efforts;
  • Automatic voter registration at PennDOT;
  • Removal of requirement to verify identity, eligibility, or residency to register to vote.

The plaintiffs are seeking to stop the ordered actions from continuing and stop any further overreach from taking place.  For more information, please see this Delaware Valley Journal article.
